How ad valorem fee works

The fee is not a flat percentage of the whole claim. Each band of the claim attracts its own rate, exactly as income tax slabs work. This means the fee rises smoothly with the claim rather than jumping at slab boundaries.

What the fee depends on

  • The suit valuation, which for a money claim is the amount sought.
  • The nature of the relief: money recovery, declaration, injunction and partition are each treated differently.
  • The state, since court fees are levied under state amendments to the Court Fees Act, 1870.
  • The forum, as tribunals and consumer forums have their own schedules.

Beyond the ad valorem fee

  • Process fee for service of summons on each defendant.
  • Fees for filing documents, applications and interlocutory matters.
  • Advocate’s fee, which is a private matter and usually the largest cost.
  • Costs may be awarded against the losing party, but rarely cover actual expenditure.
