Calendar days are used, which is the usual reading of a notice period clause. Some employers count working days instead.

Your last working day is a matter of contract, not law. What the notice period is, whether leave can offset it, and what a buyout costs are all set by your appointment letter.

Working out the last working day

Notice periods are counted in calendar days from the date the resignation is accepted, not working days, unless your contract says otherwise. A 90-day notice served from 1 August ends on 30 October.

Offsetting with leave

Whether accrued leave can be set against notice is entirely at the employer’s discretion unless the contract grants it. Many organisations allow it, some allow it only partially, and some refuse.

Where leave is adjusted, the days it covers are the days you do not serve, and the shortfall is what you would otherwise buy out.

What a buyout costs

Buyout = Daily pay × unserved days

Daily pay = monthly salary ÷ 30
The salary base — gross or basic — is set by your contract

Worked example · Leaving 30 days early on a ₹75,000 monthly gross

Given

  • Monthly gross: ₹75,000
  • Notice required: 90 days
  • Days served: 60
  • Recovery basis: gross

Working

  1. 1Daily pay = 75,000 ÷ 30 = ₹2,500
  2. 2Unserved days = 90 − 60 = 30
  3. 3Buyout = 2,500 × 30 = ₹75,000

Recovery: ₹75,000, usually deducted from the final settlement

Your rights

  • An employer cannot withhold your relieving letter or experience certificate as leverage over a disputed buyout.
  • Provident fund and gratuity are statutory entitlements and cannot be forfeited over notice period disputes.
  • Notice period clauses have been held unenforceable where they are unconscionable, though litigating is rarely worth the cost.
  • Buyouts are commonly negotiable, particularly where you help with a handover.
